Will Officers Involved In Live-Streamed Fatal Shooting Be Disciplined? Unlikely.

”The dead can’t speak!” shouted April Flores at San Benito’s leadership and elected officials at Tuesday’s city commissioner’s meeting. 

The day is significant for several reasons, it is day 179 of a 180-day deadline for the completion of an internal affairs investigation into potential police violations leading to the fatal shooting of her son Ricardo Trevino III. “All we want is the truth we’ve waited almost 6 months. Almost 6 months how much more are you all going to have us wait?” cried Flores. 

“We are expecting justice” said family spokesperson Alfonso Benavides “Officers have been fired for far less.”

On December 7th, 2018, a family member of Trevino called 9-1-1 after he had taken too many Tylenol pills and feared for his safety after he got behind the wheel. 

Trevino live-streamed as San Benito Police and Cameron County Constables followed him with lights and sirens. 

“There are two investigations” explained Benvaides, “One with the city and one with the Texas Rangers” Texas Rangers’ investigation is to determine if lethal force was justified. “There were numerous violations” said Benavides, “This was an assassination.” The Internal Affairs investigation is to determine if police department polices and procedures were violated. Trevino’s mother and Benavidez believe polices were broken and use the live-stream as evidence. Trevino parks his car, shouts “they’re going to kill me.” one officer is heard in the video counting the entry and exit wounds to Trevino’s head.

Trevino’s mother has little faith San Benito city leaders will agree to release the findings of the IA investigation, “They’re not going to release the findings. They’re not going to do any of that. They have the upper hand in that and that’s what they’re going to do mark my words.”  

After multiple requests for several weeks, San Benito has declined to speak with LOCAL 23 on the matter and forward our questions to attorney Ricardo Navarro. 

Texas Rangers are also investigating if officers fired at Trevino’s vehicle during the pursuit.
