Attorneys Want To Review State Rep’s Blood from DWI Arrest. Here’s Why

“We’re not asking for any special treatment.” said State Rep. Rene Oliveira’s Attorney Ed Stapleton to County Court-at-Law No. 1 Judge Arturo McDonald Jr. Thursday, Oliveira’s legal team and Cameron County Assistant District Attorney Rehaman Merchant mulled over bond conditions. “No alcohol, no establishment.” said Stapleton.

Oliveira is charged with Driving While Intoxicated. On April 27th, Oliveira  alleged crashed into a vehicle on Boca Chica Blvd in his hometown of Brownsville, TX. The state rep, according to Brownsville Police reports News Center 23 obtained, gave the driver his business card and said “I’ll take care of everything” then drove away. Not far behind were Brownsville Police Officers who spoke with a witness who said “nothing had happened” and left the scene. The woman who told police nothing happened was later identified as Oliveira’s wife. The victim told Brownsville Police the man who hit her was Rene Oliveira. Officer then showed a facebook photo of Oliveira and the victim said “yes, that’s him.” Later that evening, Brownsville Police officers located Oliveira at his home and arrested him for suspicion of driving while intoxicated. According to the report, Oliveira had difficulty walking and slurred speech. However, Oliveira’s attorney questions if he was over the legal limit. “It’s not illegal to drink and drive.” said Mr Stapleton to News Center 23. 

According to court records, Oliveira blood alcohol content was .015, “When they take blood, they put a little bit of alcohol on your [skin] and they stick the needle in. Sometimes that need a will pick up alcohol when it goes in so you got to be real careful.” suggested Stapleton. 

The motion to gather records how Oliveira’s blood was test, who test the samples, the machines efficiency and if the samples were handled correctly were agreed upon by Cameron County District Attorney Luis Saenz’s office. 

Oliveira’s scheduled trial case is set for September 17, 2018.
