In Edinburg Friday the last witness in the John Allen Rubio re-trial took the stand. A psychiatrist's testimony for the prosecution stated that Rubio was not insane when the murders happened.
Rubio is accused of beheading three children back in 2003, and is being re-tried since his conviction in the case was overturned on appeal. Rubio has pleaded not guilty by reason of insanity, and the state is seeking the death penalty. The judge released the jurors Friday at around 3:30 and closing arguments are set for early monday morning. Before they left the judge gave strict orders.
"Adhere to all the rules and instructions I have given to this point I would hate to declare a mistrial because one or a group of people not following instructions at this court."
Throughout the trial those jurors heard testimony from police officers and Rubio's wife Angela Camacho convicted of murder. During her testimony Rubio told her they murdered the children by demonic spirits.
" I don't remember I just know that he got mary jane and started cutting her head. I came from the restroom and he told me to hold Julisa's legs and I held Julisa's legs and he killed Julisa too."
Closing arguments will begin in District Court at 8am.
