The competency trial for accused murderer John Allen Rubio continued on Thursday on the last day of testimony, Daisy Martinez has more.
State prosecutors continued with their witnesses on the stand, this time calling up a former Cameron county jailer and a neuropsychologist. Rubio was convicted of capital murder for the death of his three children back in 2003 and the conviction was overturned. Now defense attorneys allege that Rubio is delusional and cannot stand a second trial for the alleged murders. Dr. John Stewart, a licensed Psychologist in Arizona, was brought to and licensed in Texas to testify. He stated he first met Rubio in July of 2009 and interviewed and tested Rubio for 11 hours. The Dr. also stated that during his evaluation of Rubio that Rubio admitted to constant drug abuse of marijuana, crack cocaine and that he sniffed spray paint since he was 20 years-old.
Jurors are expected to begin deliberations on Friday to decide if Rubio is competent to stand trial.
