BROWNSVILLE, TX (KVEO NEWSCENTER 23) — Brownsville police have charged a man with two counts of intoxication assault after their investigation indicated the he was the driver of the vehicle and not a passenger.
On Sunday, December 22nd, at around 7:15 a.m. police were called to an accident scene at the intersection of Boca Chica Blvd. and Highway 48.
Officers report that the two vehicles, a gray Dodge Charger and a green Ford F-150, were involved in a accident that caused the female driver of the F-150 to be ejected from the impact and the two men, in the Charger, to suffer non-life threatening injuries.
Witnesses say the driver of the Charger disregarded one stop light, in front of Home Depot, and then a second stop light at the intersection striking the Ford F-150 as it was heading east.
Officers identified two occupants in the Charger as Raul Montes De Oca and his 23 year-old cousin who stated to police that the driver, who they knew as Gil, had fled the scene.
Officers questioned witnesses at the scene and they reported not seeing anyone exiting the Charger and fleeing the accident, additionally police were able to view surveillance video, from a nearby McDonalds, and it was able to indicate that a third person had not fled the area. Investigators were able to determine that De Oca and his cousin were the only two occupants in the vehicle.
The female driver was taken to a hospital with a fractured skull, broken arm and leg, De Oca and his cousin were also taken to the hospital where authorities were able to draw blood from De Oca, to determine his blood alcohol level, after he first refused.
On Tuesday, December 23rd, De Oca was formally charged with two counts of intoxication assault with a vehicle and one count of resisting arrest and handed a $250,000 bond per count of intoxication assault and $5,000 for resisting arrest.
