Hidalgo county investigators say one of the men shot at the Palm Nursery in Donna admitted they were planning to rob it.
Hidalgo County Sheriff Lupe Trevino says one of the victims told investigators, hours after the attack, that they had scoped out Graham Garfield's family palm tree nursery because they were planning to break into the business.
Trevino says it still does not justify Garfield opening fire on the three men. Deputies found no trees, tools to weapons inside the car. Trevino says that gives Garfield no reason to shoot at them.
Garfield is out of jail after posting the reduced $100,000 dollar bond.
