Brownsville Police say they're closing in on the case on the first murder of 2009.
One man is under arrest, but another remains on the run tonight.
Police say for days they were on the look-out for two murder suspects.
This afternoon, they nabbed one of the men wanted for the shooting of a Brownsville man.
32-year old, Rolando Garza is now behind bars.
Today, Officers say, they arrested Garza on Alton Gloor Blvd., at a relative's home, as he was getting into to his car.
We had an active warrant for him we have officers looking out for him and they arrested him on-site.
Sgt. Jimmy Manrrique says, Garza was a suspect in the murder of
30-year old Aaron Castillo.
Castillo was shot to death, Monday night, outside his home on Garden Street.
A confronation began blocks away, then police say two suspects followed Castillo, and shot him at least three times, outside his pick-up truck.
Days later the first arrest has been made....
But Garza's Attorney, Rick Canales says, His client should not have been arrested.
"The whole deal is to negotiate the surrender, because he said he had nothing to fear."
Canales says, he talked to the cameron county district attorney's office and they were working on negotiating a surrender with police, instead of an arrest.
"All of a sudden police got out and arrested him, without notice to us," he says.
Police say, They had a warrant, and followed all necessary procedures.
Now, they're confident they'll arrest the second suspect, 27-year old, Randal Bolivar.
"He's still wanted and we're still looking for him, there's an arrest warrant for him and when he's seen, he'll be arrested as well."
Garza will spend the night at the Brownsville jail, until his arraignnment tomorrow morning at ten.
A bond will be set at his arraignment.
