BROWNSVILLE, TEXAS (KVEO NEWSCENTER 23) — A Harlingen man's appeal on capital murder has been denied by an appellate court.
The 13th Court of Appeals upheld the conviction of Jose Antonio Trevino, 22, on capital murder and the life sentence he was given in the death of Rose Marie Gonzalez in 2009.
Trevino was convicted in October of 2011 in the murder case of Gonzalez , who's body was found inside a refrigerator of her Harlingen apartment, and an autopsy revealed that she had been killed by asphyxiation associated with deadly blows to her head and chest.
Trevino appealed his conviction and sentencing arguing insufficient evidence and inadmissible testimony.
