SAN BENITO (NEWS CENTER 23) — On Tuesday January 22, 2013, at 9:37 am, a San Benito Police Officer responded to the 100 Block of Las Palmas Court in reference to a past burglary of a vehicle. While taking the report the police officer noticed a male subject acting suspiciously in the area, and made contact with the subject who was later identified as 18 year old Moses Galvan out of San Benito.
A local check revealed that the subject had several outstanding Municipal Court warrants totalling $ 2,075. The police officer then attempted to place Moses Galvan under arrest, but he began resisting by refusing to be handcuffed. Moses Galvan was placed in handrestraints, under arrest, and taken to City Jail where Municipal Judge David Garza
arraigned Moses Galvan on the charge or resisiting arrest class A Misdemeanor, and set bond at $ 5,000.
On Wednesday January 23, 2013, at 01:07 am, a San Benito Police Officer observed a red 2003 Pontiac Sunfire traveling south by the 600 block of South Sam Houston at a high rate of speed. The police officer confirmed his suspicion with the patrol unit’s radar, and initiated a traffic stop by said location. The police officer then made contact with the driver who was identified as 37 year old Lupe Perez Delgado out of San Benito.
The Police Officer noticided that the driver presented signs of impairment due to alcohol consumption, and administered a field sobriety test on the driver. The police officer then determined that the driver was in no condition to operate a motor vehicle, and requested a breath sample from the driver. Lupe Perez Delgado was then taken to the San Benito City Jail where a breath test indicated that his blood alcohol content was over the legal limit.
Lupe Perez Delgado was charged with DWI class B misdemanor, and arraigned by Municipal Judge David Garza who issued a $1,000 personal recognizance bond.
