Judge rules Florida county's beach smoking ban unenforceable.
Smokers in Sarasota County, Florida just got the go ahead to light up in county parks and beaches again.
A judge ruled a ban placed by county commissioners is not enforceable.
Sarasota County Attorney Steven DeMarsh notified Sarasota commissioners just this week that a recent court decision declared local government does not have the authority to ban smoking in public outdoor areas.
Only the Florida legislature can make such a ban.
The news was welcomed by smokers on Siesta Key Beach, which was recently rated #1 in the country largely on the notion that smoking is banned.
Others aren't as happy to hear the news.
"I kind of wish they could enforce it. I don't like smoking I don't want to be on the beach and I don't want to find butts all in the sand," says Linda Kerbawy.
