EDCOUCH — EDCOUCH - Early Sunday morning, DPS responded to a fatal auto-pedestrian accident in Edcouch on Mile 4 West and Mile 19 North Road. But, after further investigation, DPS called the Hidalgo County Sheriff's Department to investigate a murder.
Deputies believe Sergio Garcia, 23, intentionally ran over and killed his girlfriend Jillilah Rivas, 17, after they argued during a party.
Investigators believe Garcia wanted to keep partying, while Rivas wanted to go home. The argument escalated when Garcia hit Rivas several times, after which she left the house on foot. As she walked in the dark, she called her mom.
"Talking to her mom, telling the mother, "We have had an argument, an assault, he has assaulted me, I am really not sure where I am at, this is where I think I am at, please come pick me up." And it was then, the phone went dead. and we believe it was at that point when he intentionally ran here over," said Sheriff Lupe Trevino, Hidalgo County.
After Rivas left the house, Garcia left too, driving his Ford Explorer.
Witnesses told investigators they saw Garcia drive around them, swerved several times in the road, then drove directly into Rivas, who was walking on the grass beside the road.
No tire marks are left of the pavement, which leads deputies to believe that Garcia made no intention of slowing down before hitting Rivas with his vehicle.
Witness then told deputies, Garcia picked up Rivas's body, taking her body back to his house. It was there, she was found dead by DPS.
Garcia has an extensive criminal past as a juvenile and he is an illegal alien. These two factors have deputies worried, which is why they are making a request to Immigration and Naturalization Services (INS).
"In case he does make bond, to put a detainer on him to make sure he is not deported, before he is brought up on our state murder charges," said Sheriff Trevino.
The sheriff believes Garcia will disappear if he is returned to Mexico.
Garcia is charged with first degree murder. His bond is set at $500,000.
