After being found guilty of murdering three Brownsville children and sentenced to death, John Allen Rubio may have to stand trial again after the Texas Court of Criminal Appeals overturned his conviction.
29 year-old John Allen Rubio had been scheduled to stand trial next month for the murder of the three children, but the court wants to first find out if he is competent to stand trial a second time. A jury trial is now scheduled for September and the outcome of that competency trial will determine if the capital murder trial will proceed.
