Looking for change of venue.
John Allen Rubio walked into court today, as Judge Arturo Cisneros Nelson was to decide for a change of venue for Rubio. If granted, a jury at the new location will decide if he's competent to stand trial. Rubio's attorneys say there has been too much media attention to the case, claiming potential jurors mught have pre-conceived conclusions.
Rubio was convicted in 2003 on three counts of capital murder in the deaths of his three children, he pleaded not guilty by reason of insanity during his trial, a jury sentenced him to death, but in 2007 the Supreme Court reversed his conviction, granting him a new trial. Rubio remains in jail at the Carrizalez-Rucker Detention Center, charged with capital murder.
