The family of the first American to die from the H1N1 flu virus, Judy Trunnell of Harlingen, filed a lawsuit against a pork company, who they believe is responsible for her death.

The family's attorney, Marc Rosenthal says the law suit file at the Cameron County District Court, is seeking damages from Smithfield Foods, which is the largest pork producer for the United States. Their farm is in La Goria, Mexico where the H1N1 flu is said to have originated. The family is seeking an amount not to exceed $1 billion dollars.

Rosenthal believes the 33 year-old Mercedes teacher got the virus from one of her students.
