A suspect's daring jump to freedom leaves him flat on the pavement and behind bars, Shelby Kosto has the story.

Watch as 42 year-old suspect Eric Simmons reaches his arm out of the cruiser window, unlocks the door and out he goes, tumbling out onto the street.

Officers quickly take him into custody and handcuff him, "Get on your stomach! You're not gonna win dude, knock it off!"

Officers were traveling about 15 to 20 mph when Simmons dove out of the car, Assistant Chief Bob Chabali, Dayton Police Dept., "He was supposed to be in handcuffs, the window should not have been down."

Dayton Police Assistant Chief Bob Chabali says Simmons was picked up by officers on North Main, he was wanted for burglary, after being accused of breaking into a home on Lindale on August 27th.

When he was placed in the cruiser veteran officer Adam Sharp and new officer Douglas Gresham failed to put handcuffs on Simmons while transporting him to the police department, they also left the back window down.

Police Assistant Chief Bob Chabali, "Obviously there are some clear violations that officers are involved in so we are reviewing all the video information and there will be discipline generated out of this."

Assistant Chief Chabali, says suspects should always be handcuffed when being transported, the only times people are not handcuffed, if they are a witness to a crime and just being taken in for questioning.

Simmons was considered a dangerous suspect with a criminal past.

Just two days before his arrest, officers sprinted to the scene of a burglary with guns drawn on Lindale Avenue, police say Simmons took off from the scene in a pickup, as he drove away, he reached under the seat.

The officer thought he was reaching for a weapon and fired a shot.

Simmons was never hit and got away that time, but his luck ran out the early morning of August 29th when he foiled plan to escape came to a rolling end.
