RGV DME owner sentenced to prison for health care fraud

The owner of RGV DME has been sentenced to 12 years in federal prison for $11 million dollars in health care fraud.

Marcello Herrera, 40, his wife Carla Cantu Herrera, 32, and former employee Ramon De La Garza, 52, all pleaded guilty on February 21, 2013 to conspiracy to defraud Medicare and Texas Medicaid of $11.1 million in false claims.

Marcello Herrera was handed a sentence of 10 years on the conspiracy conviction and an additional 2 years for aggravated identity theft which will be served consecutively to the sentence imposed.

Marcelo Herrera admitted to the submission of  false and fraudulent claims for which he illegally received in excess of $6.1 million. Carla Herrera and De La Garza admitted to filing fraudulent billings of over $9 million and receiving illegal payments of over $5 million dollars.

Herrera has been ordered to pay restitution to Medicare and Medicaid in the amount of over $6 million and to forfeit all medical equipment stored at a facility in Alamo.

Ramon De La Garza and Carla Herrea sentencing dates are scheduled for July 24th and August 27th of this year.
