MISSION- Police say an Upper Valley man is facing capital murder charges for violently hurting his five year old step-son who died after being hospitalized.
According to police, the incident happened off Sofia street near Los Milagros street in Mission Tuesday evening. A 28 year old man, who is from Matamoros, took his step-son, Andres Manuel Ortiz to work in that area. Police say Ortiz had been ill for about three weeks, with symptoms like vomiting and diarrhea. Police said the man got frustrated with the child and lost his patience. According to autopsy results, it indicated serious trauma to the boy's upper body and that's what led to his death.
"The confession provided by his step-father where he claims that he lost patience and unfortunately assaulted the child with his hands in numerous areas of his upper body then made the child even weaker besides the health the child was already in that cause them to drive them to the hospital and eventually led to his death," said Martin Garza of Mission Police.
The step-father's name has not been released, but he's expected to be arraigned Thursday afternoon. Police say the mother of the child has two other kids and Child Protective Services is investigating her as well.
