The family of a Mexican teen, shot and killed by a Border Patrol agent, is suing the United States government.

The lawsuit filed on Monday, says that in June of 2010, 15 year-old Sergio Guereca was playing with a group of his friends near the border between El Paso, Texas and Juarez, Mexico when an agent fired his gun and hitting Sergio in the head. The lawsuit says the teen was unarmed and standing legally on the Mexican side of the border, but FBI investigators say the agent was surrounded by the group and being pelted by rocks and shot in self defense.
