Defendant in Murder Trial Takes Stand

Saturday, September 11, 2010 - 7:53am

According to prosecutors, Luis Carlos Santibanez is guilty of killing Joan Sebastian Saldivar back in December of 2008.

The reason Santibanez killed Saldivar stems from Santibanez believing that Saldivar had burglarized his truck  and the men began arguing. The defense says Saldivar pulled out a screwdriver, and out of fear, Santibanez pulled out his gun. Both men then fell out of the car and the gun was discharged twice with one shot hitting Saldivar in the head.

The defense says the gun fired accidentally and that he didn't want to shoot, but prosecutors are saying otherwise. While on the stand , Santibanez was asked to read statements from a interview he had with police.
