COLORADO - The Alleged gunman in the Colorado movie theater shooting, James Holmes, is being evicted from his apartment.

The landlord of the building says holms violated his lease when he allegedly "Murdered numerous indiciduals" and Booby trapped his apartment.

An attorney for the Landlord says eviction papers were filed because Holmes' Lawyers have not agreed to Voluntarily surrender the apartment.

Holmes is charged with killing 12 people and wounding 58 more at a midnight showing of "The Dark Night Rises" Back on July 20th
