Rubio Competent to Stand Trial

In District Court in Cameron County a jury finds John Allen Rubio mentally competent to stand trail for capital murder.

At 2:35 pm after a jury deliberated for 90 minutes came back with a verdict.

"The state vs John Allen Rubio in the 138th District Court in Cameron County Texas, we the jury find John Allen Rubio mentally competent to stand trail at this time."

Rubio was convicted in 2003 on three counts of capital murder of the death of three children, but the conviction was reversed the by Texas Court of Criminal Appeals in 2007.

At Friday's mental competent verdict the jury was free to go at 3 pm and Rubio was taken out in handcuffs.
Jury selection and a punishment for this trail could began as early as mid April.
A status hearing is set for March 11 at 10 am.
